A group of American information technology workers Wednesday renewed a challenge at the D.C. Circuit to an Obama-era rule allowing the spouses of highly skilled visa holders to work in the United States, claiming the U.S. Department of Homeland Security exceeded its authority when issuing the regulation.
In a new opening brief, filed after the court paused the case for almost a year, Save Jobs USA doubled down on its arguments that former President Barack Obama’s DHS violated the Administrative Procedure Act when it created the H-4 visa program in 2015. That visa program gives work authorization to the spouses of individuals on H-1B visas, which are reserved for highly skilled foreign citizens in specialty occupations. Read the full story at Law360.
